Consignment Agreement

This agreement applies to all goods consigned with La Familia Street Culture (Pty) Ltd. ("we", "us", "our") at our stores located at:
- 38 Wessel Rd, Edenburg, Johannesburg

1. Overview
These terms apply to all footwear and goods ("Goods") accepted by La Familia for sale on consignment in-store or online. By consigning items, you ("the Consignor") agree to the terms below. This agreement is legally binding and forms part of our Terms of Use.
2. How It Works
- You submit a Consignment Request with the brand, model, size, and other details.
- We’ll assess the request and respond with a Confirmation listing accepted items, commission rate (30%), and estimated resale price.
- Only items listed in the Confirmation may be delivered in-store or shipped at your expense.
- We may reject any items at our sole discretion. Rejected Goods must be collected within 14 days or will be considered Abandoned Goods.
3. Ownership & Authenticity
You confirm that you are the legal owner of all consigned items and that all items are 100% authentic and free of encumbrances.
4. Pricing & Sales
We reserve full discretion over how and where your items are marketed and sold, including promotional activity and price adjustments.
We may reduce the item price below the original minimum to facilitate the market value without requiring your approval. We cannot guarantee when or if items will sell.
5. Payment & Commission
- We retain a 30% commission on each item sold.
- We absorb all payment processing and card fees.
- The remaining 70% payout is transferred to you via EFT.
- You must submit an invoice in line with South African tax law to receive payment. A valid ID and the original Confirmation are required for processing.
6. Withdrawing Items
- Items may only be withdrawn after 30 days from delivery. If you request an earlier withdrawal, a R300 admin fee per item applies.
- Withdrawals must be arranged in advance and collected in person with a valid ID and Confirmation, or shipped at your expense.
- Withdrawn items may not be re-consigned.
7. Abandoned Goods
Goods not collected within 14 days of rejection or withdrawal notice are considered Abandoned and become our property. We may donate or dispose of them at our discretion without liability to you.
8. Risk of Loss
Goods are your responsibility until received in our store. We will handle and store all items with reasonable care, but we are not liable for loss or damage due to theft, fire, customer mishandling, or natural disasters.
9. Returns & Adjustments
We reserve the right to issue refunds or price adjustments at our discretion if a customer reports a latent defect. Your payout may be adjusted accordingly.
10. Mail-In Consignments
All terms apply equally to mail-in consignments. You are responsible for shipping costs both ways. We will communicate via email or courier regarding Confirmations, payments, and returns.
11. Legal
This agreement is governed by the laws of South Africa. It may not be altered without written approval from both parties. By consigning with La Familia, you agree to these terms.
